Responsible Brokerage
As a brokerage professional, you are expected to be knowlegable about the requirements surrounding the Recreational Craft Directive (RCD), first introduced on the 16th June 1998.
The RCD requires that all non-exempt recreational craft should be fully compliant before being 'placed on the market' or 'put into use'. This effectively means that it is technically illegal, to use or advertise any craft, for which compliance cannot be demonstrated. Compliance here includes justifiable exemption.
Typically, RCD compliance is demonstrated by a combination of a correctly formatted CE Plate (or Builders plate with CE Mark) and supporting documentation, which may include an Owners Manual (OM) and a Declaration of Conformity (DoC). For boats certified after 1/1/2006 these documents should also include a Post Construction Asssessment (PCA) Certificate issued by an appropriate Notified Body.
As a brokerage professional you must be confident that the documentation provided is genuine and should seek expert advice where any concerns exist. It is an unfortunate fact that craft often have false documentation, especially for craft assessed before the introduction of PCA in 2006.
